Divorce and separation can be very stressful and upsetting. It is our aim to combine sensitive advice with decisive action and to provide a personal service to minimise distress.

When you decide to separate or shortly after separation it is essential that you contact us as soon as possible. You can communicate with a divorce solicitor, who will give you sound legal advice from the outset so that you are properly informed before you make any decisions with regard to the breakdown of your marriage and divorce.

When you separate there are various options:

  1. Enter into a separation agreement to regulate arrangements with regard to the children and financial arrangements. These arrangements are always subject to review by the court in subsequent divorce proceedings.

  2. Judicial separation - you have all the same financial remedies as divorce except a Pensions Sharing Order but your marriage is not dissolved.

  3. Divorce - you must have been married for at least 12 months and one day before you can commence divorce proceedings. You have to also show that the marriage has irretrievably broken down and this is evidenced by one of the following grounds:
    1. Adultery
    2. Unreasonable behaviour
    3. Desertion after two years apart
    4. Two years separation with the consent of your spouse
    5. Five years separation
    The procedure is the same regardless of the grounds for divorce. Once divorce proceedings have commenced you can apply for a financial order, including maintenance.
